Q. What if my car's been off the road?

A. If your car is off the road for, say, 5 months then you do not need to tax it for that period. However, you must submit a Statutory Off Road Notification (SORN) to the DVLA. This is available from the post office. If you take your vehicle onto a road before taxing it and you are caught doing so, you will be liable for the full back duty, even if its only on the road for a few hours. Its no good saying that it has been off the road for any length of time because the courts have got wise to the fact that this is a standard defence argument. You can also be fined up to £1000 or 5 times the annual duty for your vehicle, whichever is the greater. There is also the possibility then of having to answer a charge of making a false declaration on the SORN as the vehicle is no longer off road. The maximum penalty for this is £5000 and 2 years imprisonment. Submitting a SORN protects you in case of any proactive action from the DVLA during the period that your vehicle is off the road.

Q. What if I lose my tax disc or have it stolen?

A. If you lose a tax disc you can obtain a duplicate by picking up a form from the post office and the new disc would cost only a nominal fee. A note in the windscreen saying something like Tax applied for is no guarantee of not being reported because the Police know that this has been used so many times to hide the fact that there is no valid tax for a vehicle. If the vehicle is genuinely taxed then the DVLA will not take any action.

Q. Can I take the tax off my old car and put it on my new one?

A. No, you cannot. This is an offence of fraudulently displaying a tax disc and is more serious than not displaying one at all. Take the old tax disc to the post office and you can then surrender it for a refund of the outstanding revenue. You then need to purchase a new tax for the new car.

Q. Can the DVLA take possession of my car if I don't tax it?

A. Yes. If your car is untaxed, the DVLA is now entitled to clamp the vehicle when it is found on a road and to then remove it. You would then have one month to claim your vehicle, pay the costs and any penalty and to tax the vehicle. If you fail to claim the vehicle it would be crushed and disposed of.
